I live in a small country town. I meet people who have never left here. I am always stunned at their innocence.... I come from New York. They make fun of us here. We New Yorkers have survival skills. We protect our asses. Yeah, southern charm is nice.... but I wouldnt give up my gorilla training for anything............... Preamble to:

I stopped off to have dinner tonite at a small local restaurant. Ate alone, at the counter. The meatloaf is great. Salad, coleslaw.creamed corn, Iced tea

8.95 ( I left a 5.00 tip ) Talked while I ate, to the woman behind the counter. She works the register. Shes been there for 17 years. She is obese. She has a lovely face. She barely makes enough money to survive, Shes never really recovered from a cheating husband who left 5 years ago. She is very kind. Her only form of entertainment is the internet. Shes a member of True. com Not for romance.... for frienship. She was corresponding with a man on there for years. A few months ago he talked to her on yahoo messenger. Told her that he was stuck in London. He sent her a check for 4,000.00$ Asked her to cash it, and western Union him the money. She deposited the check It cleared. She wired him the money. He stopped the check.. She had to take out a loan with her bank to pay the 4,000.00

129.00 a month for 4 years. She doesnt really have very good verbal skills. Shes sort of helpless. His bank was Wachovia in Maryland. Banks say they can do nothing. True,com can do nothing. I am on a mission. I WANT HER MONEY BACK. I WANT TO VERBALLY TERRORISE(?) this man. He targeted her. He profiled her, based on all of the characteristics I described above.

HE IS A PREDATOR SHE IS A VICTIM who does not have the smarts to help herself. Does anyone have any ideas where to begin? His screen name on True.com is...... Henry4Lov.com...... Anyone know him? I am going to start with Wachovia...... I will smoke him out of the bushes. Wanna Help?

If the check cleared while it was in her acct how could he stop pymt ?

Anyway Im sorry but this is just too gullible.

Im sorry for her but you cant hold everyones hand all the time. If shes on the internet she should be aware of the predatory practices out there.

While this guy does deserve a swift kick in the as5 the problem is Wachovia's.

They cashed the check. It now becomes their check.

I fight that one all the way to the top.

Now as far as rubbing this guys face in the dirt pm me and I'll take you to a place that, ahem, specializes in such matters.;)

You have a problem with the word "cleared", it can be used loosely and it can be used accurately.

https://www.wachovia.com/personal/onlin ... sure_group has the terms and conditions at the Wachovia banking group. The terms they use look pretty standard, it's possible to check whether they're the same terms that apply to the account the money didn't get to.

I don't want to "summarise" because the words are all there for a reason. What they say is that (for checks under $5,000, I think - it doesn't say so but I think that's a general banking rule now) Wachovia make the money available next day, but that if the cheque subsequently fails to clear the resulting debt is yours. It sounded as though the cheque in question was on a US bank, in which case they'd release the funds next day and clearance is a separate matter. If it actually was a foreign check then they broke their own bank rules and they ought to make recompense, but the tale suggests it wasn't.

Here's the Wachovia Rules, anyway.

DEPOSITED FUNDS AVAILABILITY

WHEN FUNDS ARE AVAILABLE FOR WITHDRAWAL

Our policy is to make funds from your deposit available to you on the first business day after the day we receive your deposit. When available, you can withdraw the funds in cash, and/or we will use the funds to pay checks that you have written. For determining the availability of your deposits, every day is a business day except Saturdays, Sundays, and federal holidays. If you make a deposit before 2:00 p.m. (unless otherwise posted) on a business day we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after 2:00 p.m. or when otherwise posted in our bank offices, or on a day we are not open, we will consider that the deposit was made on the next business day we are open. Funds availability may differ for deposits made or accounts opened in other Wachovia locations. Availability schedules may be obtained upon request.

FOREIGN CHECKS

Checks drawn on banks outside the United States are sent for collection instead of being deposited directly into your account. Any non-US checks deposited will be returned to you via US mail. Please speak with a Financial Center representative to assist you in collecting funds from non-US checks and to understand associated collection fees. Funds will be deposited after we receive payment for the check from the bank on which it is drawn.

COLLECTION OF ITEMS

All deposited items (including those drawn on another account at the Bank) are credited subject to final payment and our receipt of proceeds. If you deposit foreign currency or items that are denominated in a foreign currency into your account, the final credit to your account will be based on the exchange rate in effect at the time we receive final payment for that item in United States currency. Without prior notice to you, we may charge back any item at any time before final payment, whether returned or not, and we may also charge back any item drawn on us if the item cannot be honored against the drawer's account. If you have insufficient funds in your account to cover a returned item, we may overdraw your account in accordance with this Agreement. We are authorized to pursue collection of previously dishonored items, and in so doing we may permit the payor bank, to hold an item beyond the midnight deadline. At our discretion, you authorize us to convert any checks that you deposit into your account and that are returned for uncollected or insufficient funds to an electronic transaction.

If any check or other item deposited in your account is returned to us by the bank on which it was drawn through the Federal Reserve, a clearing house or other normal check return channels, we may accept that return and charge the check or other item back against your account without regard to whether the bank on which the check was drawn returned the check before its midnight deadline. Furthermore, if, after a check or other item deposited into your account is finally paid, it is returned to us by the bank on which it is drawn because someone has made a claim that the check or other item was altered, forged, unauthorized, or should not have been paid for some other reason, we may debit your account for the amount of the item. If you have insufficient funds in your account to cover a returned item, we may overdraw your account in accordance with this Agreement in an amount equal to such check or other item. You agree to reimburse us for any cost or expenses we incur in connection with any such claim (including, without limitation, attorneys' reasonable fees and court costs) and agree that we may impose service fees against your account for processing any such claim as reflected in our Schedule of Fees and Funds Availability for Personal Accounts from time to time.

I was thinking that too.

The key get-out clause is:if, after a check or other item deposited into your account is finally paid, it is returned to us by the bank on which it is drawn because someone has made a claim that the check or other item was altered, forged, unauthorized, or should not have been paid for some other reason, we may debit your account for the amount of the item.What shocks me is that people agree to terms like that.

OK...... THE CHECK ( Which was his ) WAS CLEARED BY HER BANK. THEY GAVE HER THE CASH. ( He was supposedly in London) SHE WESTERN UNIONED HIM THE CASH. hER BANK NOW TELLS HER... HE PUT A STOP ON THE CHECK. Shed did report him to the bank... everyone says they can do nothing. If we were all able to collect funds and stop checks for no reason, we would all be wealthy. I say the answers have to come from Wackovia.

Last January, I had an incident with someone charging my checking acc with membership fees to adult porn sites. At first the bank credited my acc. 3 months later, they took the money back. Sent me a letter stating that the charges seemed to be authorized. IT WAS INTERNET FRAUD. Spot helped me file the necessary government complaint papers. I also filed a local police report. Got the perps IP address which was not my IP adress. Got his e mail

address from the clearing house Click.com. I wrote the bank a letter telling them that no..... I was not satidfied with their decision. Not only did I not join the porno sites, or authorize the fees.... They were compromising my integrity, and challenging my honesty. I GOT MY MONEY BACK.

She signed that agreement to open the account. It's the standard terms and conditions.

The bank made the deposited funds available for withdrawal, as they'd agreed to. The deposited funds were withdrawn by her. The check was returned to the Walochia by the issuing bank as worthless. The Walochia debited her account for the amount of the item, as she'd agreed to let them do. There really is no way round the problem from the Walochia end, they did exactly what they said they would do.

I do understand what you are saying, and I agree. Just recently I deposited almost 7,000.00 in checks ( 2 checks) payment for a landscaping job. The money was taking forever to clear. I needed to pay the suppliers. Finally the bank manager took the hold off 4,000.00 and they gave me the cash. As I proceeded to disburse the money... I kept thinking, what if there is a problem with the deposited checks and the bank asks me for the 4,000.00 back? At my bank, I think they waited long enough to know that all systems were go. Her bank shouldnt have given her the money... until they had their money. So... maybe there is some liability on the part of her bank. ( Which I will need to find out the name of)

The bank has an obligation to tell the customer the rules they apply when making funds will be available for withdrawal. It's discussed at the Federal Reserve on http://www.federalreserve.gov/pubs/regcc/regcc.htm

As far as "Her bank shouldnt have given her the money" goes, the bank actually has a legal requirement to give her at least some of it the next day. Beyond that minimum required by law the bank can make its own rules, so long as it tells the customer what they are and the rules are what actually happens.

Try going back and check the terms and conditions I highlighted. Would it not make sense that the bank would only have terms and conditions that were enforceable in a court? Why else would they get the customer to sign terms like those if they weren't legal? It wouldn't be in their interest.
