Sounds like this guy is just trying to cop out with a lame excuse!

Rules are rules! A few years ago I had to let one of my subordinates go for abusing the Internet during working hours. He was also warned several times that is was against the company rules to use the companies internet for personal use. After the fourth time he was cought using the companies internet for personal use, where he was selling his items for sale on line He was Fired! And then he also brought a law suit againt the company & myself, & he LOST!!! Rules are Rules!
