anatomy of a defense in the making...run it up the flagpole and see if anyone salutes................. Entwistle denies killings, prosecutors unveil sex theory.......................

By Dave Wedge & Jessica Heslam

Besides the reported sex problems, the court papers reveal that Neil Entwistle told investigators he returned home from an errand on Jan. 20 at 9 a.m. to find Rachel, 27, and 9-month-old Lillian dead in the master bedroom of the family’s rented Hopkinton home. Prosecutors have said the slayings occurred sometime after 7 a.m.

Entwistle reportedly told cops he didn’t call 911, covered them up and got a knife to kill himself “but could not go through with it.” what lying crap

Docs: Rachel’s parents thought Neil was secret agent

By Joe Dwinell & Christopher Biondi/ Boston Herald and MetroWest Daily News

FRAMINGHAM - The parents of slain mother Rachel Entwistle told police they believed their son-in-law Neil was a secret government agent, according to documents released this morning at Framingham District Court. The documents also revealed that Neil Entwistle visited the Web sites of several area escort services... [more]

Computer records play large role in gathering evidence

By Peter Reuell/ Daily News Staff

Tuesday, February 14, 2006 - Updated: 04:39 AM EST

Investigators are relying on computer records to trace Neil Entwistle’s steps in the days before he allegedly shot and killed his wife, Rachel, and 9-month-old daughter, Lillian Rose.

Court papers released yesterday show Entwistle, in the days leading up to the slayings, visited a Web site that describes various ways to kill people, and searched the Internet for information on suicide.

Entwistle, who had complained about the couple’s sex life before the murder, had also searched the Internet for escort services and visited a swingers’ Web site.

As computers play an ever-greater role in everyday life, they are becoming increasingly important sources of evidence for police and prosecutors, investigators say.

"I think as people conduct more and more of their private and corporate business in computers, on computers or via computer, they’ll become a more commonly seized item," Hopkinton Police Chief Tom Irvin said yesterday.

In the days following the murders, Hopkinton investigators seized two computers and a hand-held computer date book from the family’s rented Hopkinton home, as well as a computer owned by Rachel Entwistle’s stepfather.

"It wasn’t uncommon in the past to look for all papers pertaining to a certain subject," Irvin said. "Now, it would be logical to also look for electronic (information.)"

With the help of experts from the Medford Police, state police officials say computer records show Neil Entwistle as a man squeezed from all sides by debt, mounting family pressure and an inability to find work.

Entwistle was arrested last week in London, and waived extradition to the United States. He is expected to be arraigned later this week.

While information gleaned from electronic records is becoming more and more common in investigations, most local departments said they still rely on either the state police or local district attorney’s office for computer forensic experts.

"It’s a forensic test," Natick Police Lt. Brian Grassey said. "They have people that are specifically and specially trained to comb through the records."

Officials from Middlesex District Attorney Martha Coakley’s office refused to comment on the Entwistle case, but said they do have a staff of experts trained to recover electronic data.

"It’s an extremely technical field," Massachusetts State Police spokesman Trooper Thomas Ryan said. "(It’s) an important element in all different types of cases today.

"You have a situation, with the advances in technology, we now have these computer and e-mail accounts that have the capability to store a great deal of information, and they’re utilized for communication purposes. That being the case, that type of technology is oftentimes associated with a lot of different types of criminal activity."

The need to glean information from computers is becoming so commonplace, Marlborough Police Chief Mark Leonard said, it in some cases has created backlogs.

"They’re overburdened with some of this work themselves," he said, of the state police and district attorneys. "It is more common every day that we’re -- whether it be with a search warrant or otherwise -- collecting some of this information."

"Clearly, the computer can provide a road map," said Milford Police Chief Thomas O’Loughlin. "It’s an absolute. Ten years ago, in my line of work, you would call someone over at the phone company and say, ’Tell me who has this number.

"I don’t think there’s a detective out there today who doesn’t understand the process of going to the grand jury to get a subpoena for computer records."

On the scene: Live updates from the Entwistle arraignment.............i just watched the brief arraignment of entwistle. Rachel's parents were in attendance. his court-appointed is on the courthouse steps bleating about how entwistle can't get a fair trial due to the publicity. totally predictable. he will be held without bail until march 15, when there will be a full-blown probable cause hearing.

Actually that's got to be one of the biggest differences between the UK and the US, you just would not get the police talking to the press about what they think happened like that at least not until afdter the trial. The press have to watch what they report as well or face charges of contempt of court.

Contempt of Court Act 1981

The Contempt of Court Act 1981 was enacted following a decision of European Court of Human Rights that English contempt law contravened Article 10 of the Convention. It was intended to give greater protection to freedom of speech. The Contempt of Court Act introduces a strict liability rule. The strict liability rule indicates that conduct tending to interfere with the course of justice - particularly legal proceedings - may be treated as a contempt of court regardless of whether there was any intent to so interfere.

The strict liability rule applies only to publications. These are defined so as to include any speech, writing, broadcast or other communication in whatever form which is addressed to the public at large or any section of the public.

Two important limitations on the impact of the strict liability rule are:

1. It applies only to a publication which creates a substantial risk that the course of justice in the proceedings will be seriously impeded or prejudiced.

2. It applies to a publication only if the proceedings are active.

It's not keeping things secret per se just to ensure a fair trial and try and prevent a jury being prejudiced. We maybe go too much the other way, for instance sometimes knowledge previoius convictions are kept from a jury so they remain objective about the facts of the case at hand but there have been a few cases recently where such knowledge was arguable relevant-in rape cases where there have been previous convictions or dases brought. You can understand the reasons, maybe ir's the best arguement for commom law rather than statute law, at least in th former some common sense can be applied. Not beuinga lawyer I don't prefess to know much about it.

randall here,

Dear Sheryl, for some reason that beautiful picture on your post comes up nicely on my monitor but the writing is completely unreadable on the left hand side of the picture - what is the complete message?

This is an example of my "Random Thoughts" like Mr Adrian Monk, although deeply interested in the British/US murder case I am completely distracted by your picture.

I think a wait an see attitude is the best as I live across the road from one of the most important prisons in Britain - Ultra High Security, etc. once only for murderers etc - I am shocked at the amount of men who have been found completely innocent even after 30 years. during my long lifetime.

No one cane give them those years back but at least they still have their life.

Truman Capote should be around for this "Yankee" case.

God bless

randall

Prosecutor granted delay of hearing for Entwistle

Accused wife-and-baby killer Neil Entwistle will not appear in Framingham District Court as scheduled after prosecutors requested a delay yesterday in a hearing that could have revealed critical details in the case.

Prosecutor Michael Fabbri asked Judge Paul Healy to delay the scheduled probable cause hearing until April 18 because “the commonwealth . . . has not completed its presentation to the grand jury,” Fabbri stated.

Entwistle’s attorney, Elliot Weinstein, did not oppose the request.

Both attorneys had expected Entwistle to be indicted by a Middlesex grand jury prior to the hearing. A murder case, along with several other violent crimes, cannot be heard on the district court level.

It is unknown if the case has been presented to the grand jury. The grand jury meets secretly and it is not announced which cases are being heard when. A special grand jury is not convened for specific cases. After Entwistle, who is being held without bail at the Middlesex Jail in Cambridge, is indicted, he will be arraigned at Middlesex Superior Court, where he will enter a plea.

Weinstein could also argue for bail at that hearing.

April11........CAMBRIDGE, Mass. - A plea of not guilty has been entered on behalf of Neil Entwistle to indictments charging him with the murders of his wife and baby daughter.

Entwistle remained silent during his brief arraignment in Middlesex Superior Court. He will continue to be held without bail at the Cambridge jail.

Entwistle’s attorney, Elliot Weinstein, lashed out at the press outside courtroom 10b, saying the coverage has robbed his client’s chance at a fair trial.

“The reporting in this case has done everything it can to destroy the presumption of innocence, “ Weinstein said.

More than a dozen members of Rachel Entwistle’s family were in attendance at this morning’s arraignment.

“It is a difficult time for the family — they miss Rachel and Lillian Rose every day,” said family spokesman Joe Flaherty. “But we are one step closer to justice today.”

you make good and interesting points Diuretic. if i may comment on this quote from his lawyer---Entwistle’s attorney, Elliot Weinstein, lashed out at the press outside courtroom 10b, saying the coverage has robbed his client’s chance at a fair trial.

“The reporting in this case has done everything it can to destroy the presumption of innocence, “ Weinstein said. ----oddly enough, HE has held big fat pressers on the courthouse steps both times entwistle has been in court. the DA has not. methinks he doth protest too much. it's a common device.

Nude Neil pic posted online

By Laurel J. Sweet

Wednesday, April 12, 2006 -

Days before his wife and baby girl were slain in their sleep, Neil Entwistle, trawling for bed buddies on the Internet, posted a full-length, fully aroused nude photo purportedly of himself online,:yh_pig the Herald has learned. But sources who’ve seen the graphic picture Entwistle used to complement his almost puerile, romantic pitch for sex partners aren’t 100 percent certain the well-endowed hunk is really him or that it wasn’t computer-enhanced.

“You see, they give my client no credit at all,” quipped Entwistle’s defense attorney Elliot Weinstein, who otherwise issued a firm “no comment.”

The alleged alfresco pinup of Entwistle, 27, appeared on Adult Friend Finder, a bawdy Internet sex club for swingers.

Though since removed from the Web site, the photo, taken from 7 or 8 feet away, shows a naked man sunbathing while sprawled out on a beach chair in grass, his hands appearing to rest against his genitals. It is now officially part of the investigation into the Jan. 20 fatal shootings of Rachel Entwistle, 27, and infant Lillian Rose, sources said.

Emily LaGrassa, spokeswoman for Middlesex District Attorney Martha Coakley, declined to comment.

If he did skip back to britain it's not as though he would not be extradited back to the US if he was daft enough to refuse top return. We even allow extradition of people that haven't been accused of any crime to the states where they get locked up and lose their jobs so they can't afford lawyers to defend themselves..

To Brirish eyes the kind of press reporting you see in the states before a trial is very much seen as being prejudicial to a fair trial. It just would not be allowed here, whether he is guilty or not is not a matter for trial by press.

There have been a couple of high profile cases where the press reporting before and during the trial seem to have led to a verdict decided in the court of public opinion rather than law.

the problem is i can't believe the judge would even consider bond on two counts of first-degree murder, almost unheard-of. and his passport should be confiscated...what if he's allowed to return to England and decides to skip out to argentina? what if his parents are willing to lose their house for his sake?

By way of contrast our media have to be careful what they report in case they find themslves in comtempt of court.

http://news.bbc.co.uk/1/hi/uk/6191983.stm

Media organisations have to ensure coverage of criminal cases does not influence a future jury's decision.

Once proceedings become "active", for example after someone has been arrested, care must be taken to avoid reporting anything which might create a "substantial risk of serious prejudice to a trial".

'Ethical issues'

Defence lawyer Julian Young said such reporting "can be prejudicial" as the court may decide "there can't be a fair trial".

"The ultimate public interest must be a fair trial," he said.

Would we like to follow this, now that the chap's finally in court?

This is one of those cases where the entire world knows the fellow did it and it was, moreover, a startlingly wicked thing to have done so sympathy just isn't an option. Of course the US court system lets people loose over procedural errors so his legal team's doubtless watching like hawks for something like that.

The US also has cases which should never have been prosecuted in the first place like that of Krishna Maharaj. I'd as soon visit any other country on earth as the US myself, it seems such a lottery whether you get to leave or spend a lifetime in jail there. What you actually do is far less important than what the local Gestapo decide to accuse you of.

Neil Entwistle, on the other hand, is surely the guiltiest defendant ever to have stood in any dock in all history.

Strange smell that alerted police to the crime

By James Macintyre

Saturday, 7 June 2008

Neil Entwistle was on a British Airways flight bound for the UK when police were first alerted to a strange smell emanating from his home in Massachusetts on 21 January 2006. The keys to his wife's BMW were still in the ignition in a car park at Logan airport, Boston.

When officers made their second search the following day at the house where the IT worker's 27-year-old wife and nine-month-old daughter lived, Mr Entwistle was with his parents back in Worksop, Nottinghamshire.

In the master bedroom, lying on the bed, hidden under a blanket, police found the bodies of Rachel and Lilly Entwistle.

Mr Entwistle was still in Worksop when his wife and child were buried in the same coffin on 1 February.

Two days after first speaking to Mr Entwistle, Massachusetts detectives flew to England to investigate. Having initially refused to return to the US, he was arrested on 9 February and, at 2.30pm six days later at Gatwick airport, was handed over by Scotland Yard into the custody of US marshals. Put on a private flight, he would return to the country from which he fled less than a month before, a mere one day after the shootings and just 11 days after he had settled with his wife and child in their new home.

Or how about this from the trial:

Jury sees baby's bloodied clothes

From above link:

The jury at the trial of a British man accused of the murder in the US of his wife and baby has been shown his daughter's blood-stained clothes. The white sleepsuit was worn by nine-month-old Lillian Entwistle when she was shot dead at home in Hopkinton, Massachusetts, in January 2006.

Close range

The court has heard that Mr Entwistle's DNA was found on the grip of the .22 Colt revolver used to kill his wife and daughter.

The jury was told that a post-mortem examination found Mrs Entwistle was shot in the forehead at close range. Lillian was killed as she was being held by her mother. Forensic scientist Deanna Dygan told the court that Lillian had been shot at point-blank range.

Wow..............Too bad his daughter and wife don't even have a conscience left to use

If anyone deserved the death sentance this cowardly human deserves it.

But you know his fellow inmates hate a child killer and I don't see him getting out except in a pine box.....

This is interesting...................in that the defence lawyer is a horses A$$

If convicted he'd quite probably agree with you but nobody will do him that courtesy.

It's a lousy case because the prosecution has no evidence to disprove the defense, which is just laziness on the part of the police. They - the prosecution - are relying on a jury not believing a woman could kill her daughter and herself on discovering her husband's a turd. I can't for the life of me see why the idle buggers - the police involved, that is - shouldn't have gone out and earned their pay by developing genuine forensics to guarantee guilt rather than merely leave it to lawyers to imply it in court. It's a slipshod trial based on a slipshod investigation.

He is not up for death row.............

The most he could get is life without parole.

Police sergeant testifies about discovery of Entwistle bodies

Perhaps you're right...

At least I would hope people who commit crimes like this would be tortured by their own guilt...

Although just because someone can smile after murdering anyone in cold blood doesn't mean that there aren't times when they feel completely pathetic...Again...Hopefully speaking...

Briton questioned in US murders

Post by CARLA »

He was convicted of their murders and will serve life in prison. His family in a statement said they believe his wife killed the baby, then herself because she was depressed. Sorry I'm not buying that theory at all they have their man.
ALOHA!!

MOTTO TO LIVE BY:

"Life should NOT be a journey to the grave with the intention of arriving safely in an attractive and well preserved body, but rather to skid in sideways, chocolate in one hand, champagne in the other, body thoroughly used up, totally worn out and screaming.

WOO HOO!!, what a ride!!!"
