Tampa, Fla.

Raped as she returned to her car after attending a local parade, a 21-year-old Tampa woman escaped and reported the attack to local police. As she was being interviewed, police discovered she had an outstanding four-year-old warrant for failing to pay a fine related to an incident when she was a juvenile.

Just hours after being raped, she was handcuffed and hauled off to jail.

But it gets worse. A jail worker blocked this young woman from taking emergency contraception to prevent pregnancy, stopping her from taking the required second dose for more than 24 hours longer than recommended.

The reason: the jail supervisor doesn't "believe" in emergency contraception.

++++++++++ How DARE someone deny this woman a legal medical treatment because if offends his/her personal religious beliefs?

I think even convicts get better treatment than that. I really hope the story is both oversimplified and exaggerated, because I'd hate to think of people that stupid walking around with that kind of power.

The very worst treatment she should have gotten should have been a police escort to the hospital before booking.

Really? Jaysus, thats unbelieveable. Makes you wonder what the hell is going on in people's heads down in Tampa??? That poor girl, how awful, I hope someone is made accountable for this, if the story is accurate then its a despicable way to treat a rape victim.

And yet, I've seen arguments which stress that a jail worker or pharmacist shouldn't be required to provide a drug which offends their personal religious beliefs!

So where does the jail worker's "right" end and the raped woman's begin?

I would have thought that in such cases the civil and secular law would intervene before something ridiculous and quite horrid like this would happen, obviously not, not very edifying really is it.

What it "IS" is the deliberate intrusion of fundamentalists into everyone else's life. I've no quarrel with this person's belief that emergency contraception might be wrong FOR THEMSELVES....but the idea that they can deny someone else that same "right" is infuriating!

She was victimized more than once that day!

I don't believe the law applies to rape victims...or, if it does, it should be changed NOW! This woman should've been in the hands of medical personnel, not jailers!

Yup. She was a crime victim first, criminal second. That's how the priority ought to be.

Sure...if all circumstances were "normal." But this woman went to the police to report a sexual attack! How in the world did she wind up in the hands of this jailer?

Flopstock, I value and admire your opinions on this board.

Might I suggest that she certainly COULD have done the right thing and called a doctor?

It's easy to say "I was just following orders."

The good news is that the Tampa police (probably scared SPITLESS that they'll see GLORIA ALLRED in their station next week) have taken steps to see it doesn't happen again!

Some events are so major that they should over-ride petty procedure. There was a (later) time and place for this girl to be accountable for previous misdemeanours. Her physical and mental well-being should have been the priority of all parties involved. I'm sensing a total absence of COMPASSION

KC Police Seek Answers in Case of Arrested Woman Who Miscarried

Jan 31, 2007 06:15 PM CST

By ANDALE GROSS

Associated Press Writer

KANSAS CITY, Mo. (AP) -- For now, Sofia Salva will let her attorney and the videotape of two police officers ignoring her pleas for medical help speak for her.

Salva, who said she was three months pregnant and bleeding when Kansas City police stopped her for traffic violations last February, believes she wouldn't have had a miscarriage had officers aided her.

A police videotape released Tuesday brought attention to the incident. Salva also has filed a wrongful death and personal injuries lawsuit against the Kansas City Police Department and two officers who arrested her.

"It's tragic, it's disappointing, it's frustrating, it's sickening at times," Salva's attorney, Andrew Protzman, said Wednesday. "This is a lady who was in severe medical distress and clearly needed emergency medical attention and medical treatment."

Kansas City police spokesman Capt. Rich Lockhart said Wednesday that he doesn't know how long the department's internal investigation will take. The two officers remain on duty.

"We want to ensure the community trusts us to get to the bottom of this regardless of the way it reflects on the Police Department," Lockhart said.

Salva, a Sudanese native, was pulled over Feb. 5, 2006, by officers Melody Spencer and Kevin Schnell, who had seen her affix a fake temporary tag on her car's back windshield.

"She told the officers repeatedly over the course of 45 minutes that she was bleeding, she was pregnant, she needed medical attention," Protzman said. "And they ignored her request and refused to listen to her and refused to take care of her."

Salva was taken to jail and kept overnight on traffic violations and outstanding city warrants. The next morning, Salva claims, she was released and delivered a premature baby boy who died a minute after birth.

"If Sofia could have her baby back, she would love to have that," Protzman said. "But the police took that opportunity away from her. She's pursuing the only recourse that's available to her under the law."

The suit, filed Friday in Jackson County Circuit Court, seeks actual damages exceeding $25,000 and punitive damages to punish and deter such conduct in the future.

Protzman said the officers made the wrong assumptions about Salva, who declined interview requests.

No telephone numbers are listed for the two officers, and a representative of their union, the Kansas City Police Officers' Association, did not return a call seeking comment Wednesday. Lockhart said both Spencer and Schnell are declining comment for now.

Spencer has been with the department four years and Schnell less than two years.

The videotape of Salva's police stop was released after The Kansas City Star made an open records request. The tape shows Salva telling the officers numerous times that she was pregnant, bleeding and needing to go to the hospital.

After the ninth request, Spencer responds: "How is that my problem?"

Once she's been told why she's under arrest, Salva tells the officers she is having a miscarriage and is bleeding.

"Do you want to check me?" Salva asks. "I'm bleeding. I have a 3-month baby inside."

The tape shows Schnell walking away from the car and telling his partner: "She just gave me a line of excuses. She said she's bleeding. She said you can check her."

Salva repeats that she's three months pregnant and bleeding.

"OK," Spencer answers. "Why are you driving to the store and then putting a fake temporary tag in your car?"

Salva explains that she was on her way to the hospital.

The officers make Salva sit on the curb as they search her car, purse and grocery sacks. Salva again says she's bleeding, asks the officers to check her underwear and asks to go to the hospital.

"Well," Spencer says, "that will be something you can take care of when we get done with you."

Salva becomes upset after officers take awhile to get her identifying information. "I have a baby in my stomach and I'm bleeding and I open my underwear for you to see," she says.

"Stay seated!" Schnell yells.

"If I die here, will you take care of me?" Salva asks. "If I die here?"

"Fair enough," Schnell says.

The officers handcuff Salva after learning she has outstanding city warrants for mistreatment of children, trespassing, driving while suspended and other traffic violations.

"I'm bleeding. I swear to my God," Salva says.

Schnell replies: "I don't doubt that you're possibly bleeding, but you got a lot more problems with us."

Salva, in her lawsuit, says she continued to plead for help at the jail but still was ignored.

The next morning, jailers let her go to a hospital after she passed a large blood clot.

Yes, I saw this videotape. The woman has an accent, but her statements are very clear--she asked for help and was denied it.

That happens when the people in power stop seeing the others as people and just as perps. That psych study at Stanford (I believe) showed the same thing. I experienced it myself as a young man placed in charge of a group of mildly mentally retarded teens. When they claim to have a problem, the first reflex is that they're lying. It's a dangerous thing to get, easy to go undetected, hard to control, and completely unforgiveable.

Were those studies analyzed to look at women's treatments, separated from the treatment of men?

No. The root and behavior are the same, though the results against women can be undeniably and dramatically more devastating.

This is truly an unfortunate circumstance. The woman should never have been arrested so soon after suffering such a traumatic assault even according to the local police protocol. However, there seems to be an oversight, intentional or unintentional I can't say, of some aspects of the article that is leading to more stereotypical fearmongering of a certain segment of our population.

According to the article:

"Tampa attorney Jennifer D'Angelo, who represents the jail worker, said Tuesday that her client is prohibited from giving inmates any medication without specific orders. The worker insists she never discussed religion with the woman who reported being raped."

No fundamentalism. No forcing religious beliefs down others throats. A simple case of a healthcare worker who had the understanding that she could not administer medication with proper orders. Paramedics in the field doing life-saving procedures on a patient who has coded must also get orders from a physician before administering certain meds to a patient that is dying at their feet. Nurses in hospitals won't administer meds without orders from a physician. It happens. Perhaps this healthcare worker did not have a proper understanding of her responsibilities but religion played no part.
