It just occurred to me, as I was sitting here imagining horrible things about what is going on with Matt, since I haven't heard from him since he got to Jackson. (The mind plays all kinds of really fun tricks on you.)

Anyone familiar with the law: The appeal can't make things worse for Matt, can they? I mean they can't look at the case and say, "Gee, this guy didn't get ENOUGH time, let's toss him back in for 25 years!" I've emailed my question to my appeal lawyer, but thought someone here would be able to set my mind at ease before I heard back from him. Anyone know????

Ok Diuretic, that makes a lot of sense. However, the sentence IS part of what went so horribly sideways in this case. We never expected him to get so far ABOVE the minimum guidelines!!

I will look into this more, thank you for the link, and I'll let y'all know what my lawyer answers.

Thanks, kids!! :yh_kiss

Scrat wrote: As far as I know you cannot be tried twice for the same offence. My brother was looking at time for felony assault and this question came up, the lawyer said that it would amount to being tried for the same offence twice.
That's kind of what my line of thinking was, too, Scrat. Thanks. :yh_bigsmi :-6

I know a guy here in the UK who got 18 years (life) for murder (he stabbed a another guy to death) he appealed in his 6th year and his sentance has just been deemed excessive and changed to 12 years but he will serve 12 years. I only mention this because he was GUILTY and all the evidence proved he was guilty - your husbands case is so different . Do you have any organisations that deal with miscarriages of justice that could stand behind you and offer some help . We used to have a TV programe here called rough justice that looked into cases of death in custody and wrongful arrest and cases of miscarriage of justice it helped a lot of people .:)

Diuretic, I was thinking of that one! Just could not remember the name of it. There was a television show here, briefly, last year, that dealt with a similar project. The show was called In Justice. In the show, the group took on cases of people who felt they were unfairly convicted, and tried to have convictions overturned.
