opening statements are a good indicator of how the case will go...i would personally like to grab the defense attny. by his throat and choke him....it's pretty clear he's going to go for the "OJ DNA is crap" theory. i sure hope this jury isn't as vegetative as the OJ jury. and his other pathetic tactic is "are you going to believe the video and your lying eyes, or are you going to believe my client the druggie felon"?

I know. I didnt see any of the court coverage but I watch Nancy Grace every night and she was talking about this case last night. Its amazing this isnt an open and shut case. THe video is there and its sick that its so damning, and he still gets this long drawn out trial, and finally the defense attorney is going to attempt to disprove he did it? This jury cant be that stupid!

SARASOTA, Fla. -- Scrapes, marks and bruises on Carlie Brucia's body indicate the 11-year-old girl was bound, dragged on her side and strangled from behind with a cord or string, a medical examiner testified Monday on the fifth day of the trial of her accused killer.
Carlie also appeared to be have been sexually assaulted, Dr. Russell Vega said as jurors were shown almost two dozen graphic images on a television screen of Carlie's badly decomposed body.
"My opinion remains that strangulation was the cause of death," said Vega, medical director for Florida's 12th district.

Prosecutors played the taped conversations for jurors Tuesday as they wrapped up their case against Joseph Smith. His defense attorney was to present arguments Wednesday before the case went to the jury.
The edited conversations were taped over the telephone or during jailhouse meetings in the weeks after Carlie's Feb. 1, 2004 disappearance. In one conversation, Joseph Smith told his brother, John, that he felt "good" after making a confession and an act of contrition to a priest. Carlie's disappearance received worldwide attention since a car-wash security camera captured the abduction.
"I confessed to everything, murder, all types of stuff," Smith said.
In another conversation, Smith asked his mother to explain to his ex-wife that what had happened was an accident.
"You don't think I would do that on purpose, Ma? It was an accident," Smith said on the tape. "I didn't mean to do it, Ma. She knows I'm not an animal, right?"
In another talk with a friend, Sharon "Dusty" Johnson, Smith said he was on cocaine and heroin. "I wasn't myself," he said. "This is what this (expletive) did to me."
In a jailhouse meeting with his brother, John Smith suggested that they communicate using a code, according to another taped conversation.
An FBI code breaker testified for prosecutors Tuesday that Joseph Smith told his brother in a letter encrypted in code that he had dumped Carlie's clothes and backpack in four trash bins and had dragged her body to where it was found at a church property more than four days after she disappeared.
The letter ended with Joseph Smith telling his brother to destroy the correspondence after deciphering it and "shut up," said Dan Olson, the FBI code breaker.

Smith, a 39-year-old former auto mechanic and father of three daughters, is charged with first-degree murder, kidnapping and capital sexual battery. He has pleaded not guilty. If convicted, he may face the death penalty.
His defense attorney, Adam Tebrugge, on Tuesday challenged the reliability of an FBI lab that linked his client through DNA tests to a semen stain found on the 11-year-old girl's shirt.
Tebrugge used a report faulting the FBI lab in Quantico, Va. for employing methods that were "vulnerable" to mistakes as the framework of his cross examination of FBI examiner Jennifer Luttman, who testified the previous day that the semen stain matched DNA in an oral swab taken from Tebrugge's client, Joseph Smith.
The report by the U.S. Department of Justice's Office of the Inspector General was released in May 2004 in response to an investigation of misconduct by an FBI staff biologist. The biologist was found two years earlier to have falsified lab documents to cover up the fact that she failed to complete tests showing whether contamination had been introduced into the DNA testing process.
"Methods have been put into place to prevent this from happening again," Luttman said during questioning from the defense attorney.
Although the biologist didn't work on Smith's case, and Luttman testified that there had been no contamination of Smith's sample, Tebrugge has challenged the FBI lab's reliability as a major part of the defense.
Other strategies include disputing that Smith is in a security-camera recording that shows a man abducting Carlie from a car wash parking lot, raising questions about evidence contamination and asking why investigators didn't pursue other men as suspects, such as Smith's brother, John.
John Smith testified last week that his brother made a jailhouse confession to him about raping and killing Carlie and told him where her body was. On Tuesday, Tebrugge asked the FBI examiner if she had gotten a DNA sample from John Smith. She said no, and later added it was extremely unlikely Joseph and John Smith would have the same DNA unless they were identical twins, which they aren't.
When asked if FBI lab biologists could make errors in handling, testing and recording DNA data or have a bias in a case, Luttman said: "That's a possibility."

close enough.... the next thing will be the penalty phase, where the child's family delivers their statements for the jury to consider life or death. the ONLY thing the defense can hope for in this case is to keep him off death row. but he knows it's futile. so that's why he just pulled this stunt. appeals are not won or lost on evidence or facts of the case, they are only won on legal errors in the trial record.

This makes me absolutley sick. The older I get the more "republican" I start getting (for lack of a better word). I never used to believe in the death penalty and sometimes still dont, but in cases that involve children being raped and murdered I see no other place for them to get punishment other than hell. When do you think sentencing will begin?

i'm fairly certain sentencing will occur very soon after jury verdict in penalty phase. but penalty phase could be delayed a couple weeks. it is a very solumn moment to see a person sentenced to death. in this case i look forward to it.

SARASOTA, Fla. -- A probation officer, a barber shop owner and a friend of a man convicted of kidnapping, raping and murdering an 11-year-old girl testified Tuesday that Joseph Smith was a talented mechanic, a loving father and a drug addict who wanted to kick his habit.
The series of witnesses were called by Smith's defense attorneys in an effort to convince jurors to recommend a sentence of life in prison without parole rather than death by lethal injection for murdering Carlie Brucia last year. Circuit Judge Andrew Owens ultimately will decide the sentence.
Barbara Dossey, whose daughter, Dusty, dated the defendant, said Smith always would help with repairs around her house and treated her grandchildren "as if they were his own."
Barbara Messenger, who owned a hair salon with her husband that Smith patronized, said Smith was a terrific mechanic whom she recommended to her clients. Messenger, an evangelical Christian, has written letters about spirituality to Smith in jail and said she saw the defendant with his young daughters.
"He was a good daddy," Messenger said. "Joseph is a good daddy."
Paul Grudzina, who considered Smith one of his best friends in Florida, described him as "very caring, affectionate," with his three daughters
Under cross-examination by prosecutors, however, most of the witnesses conceded they had had only limited contact with Smith and that he had kept his drug addiction hidden from them.
A former probation officer, Marcos Olivari, said Smith had expressed a desire to kick his drug habit but never enrolled himself in a drug treatment program.
The defense also planned to call two underage witnesses, whose names defense attorney Adam Tebrugge asked the judge to stop from being made public. An attorney representing several media organizations said he would object to a prohibition on using the witnesses names.

i can't start a thread and not finish it....the jury has it, they're sequestered. in florida it only takes 7 to 5 to vote death. but the judge still decides. it should come in tomorrow, friday. i have to say the piece of garbage scumbag defendant looked sedated today. totally oblivious. his mother was in court weeping, but she never testified, and his sister, an ugly sod. they never even begged for his sorry life.

Schorpen's father, Egil Schorpen, and a brother, Paul Schorpen, filed a report with the Charlotte County Sheriff's Office on Monday accusing her of stealing cash, credit cards and a ring worth $5,000.
"We are going to have her arrested for what she did," Paul Schorpen told the Sarasota Herald-Tribune. "We're looking to help her before she kills herself or someone else."
Susan Schorpen's drug use became known after the highly publicized abduction and slaying of Carlie by mechanic Joseph Smith in February 2004. Carlie, 11, was grabbed as she was walking home from a friend's house, the images captured on a car wash security camera and later broadcast around the world.
Smith was convicted of kidnapping, raping and killing Carlie, and the jury recommended he be executed. He will be sentenced Feb. 13.
Judy Cornett, who runs a Tampa crime victims' advocacy group, had taken in Schorpen and supported her during Smith's trial in November. Cornett said Schorpen also stole jewelry from her before disappearing, leaving behind a locket containing some of Carlie's ashes.
"I feel very betrayed," Cornett said Wednesday. "I took her in for three months, I supported her, I helped her get on her feet. I got her clothes, I got her a job. I spent a lot of time helping her out'.

Joseph Smith was found guilty in November of killing Carlie Brucia.
She was grabbed behind a car wash as she was walking home from a friend's house Feb. 1, 2004. Her body was found on the grounds of a nearby church four days later.
Brucia's abduction by the tattooed auto mechanic was captured by a security camera and aired by television stations around the world.
A jury voted 10-2 to recommend execution for Smith. State Circuit Judge Andrew Owens has the final word.
Defense attorney Adam Tebrugge is asking for life in prison without parole. He argues that Smith was drug addicted and out of control when he committed the crime.
Smith was on probation on a drug conviction when he killed Carlie. The crime prompted lawmakers to introduce federal and state legislation to crack down on probation violators.---this is not entirely accurate. today is his chance to speak, or his family members if they wish. the judge will not hand down formal sentencing today.

This is kinda vague. :yh_rotfli loved the judge. he addressed all mitigating and aggravating factors. mitigators carried little weight. then he said "you have forfeit your right to live". in florida he will be on fast track to die. since he admitted guilt the appeals won't go on 20 goddamn years. in any case, death row in florida won't be too pleasant for him. it's bad. note--Carlie's mother still in jail, not at sentencing.
