Ok the representative came out today, i kinda expected a guy in a suit for some reason, the guy who came looked very intimidating and had no facial expressions whatsoever.

He looked, photographed and told me that obviously in the tanning process some particle had been on the leather and then came off and he could fix it.

I asked him to explain how i could manage to insert my nail into it and would he not class that as a nick. He refused to class it as a nick and was very patronizing to me explaining it again. I asked him not to insult my intelligence and found his excuse unacceptable. He left saying he would have to contact head office.

don't take no for an answer.

does you receipt say 3 days for exchanges?

He was patronizing you, you should call their head office and file a complaint.

No i would not file a complaint about the guy, he was just doing his job. He's no doubt trained to do his best to get customers to keep the goods, i mean what use will the sofa be to them on return.

I'm not saying its right, just that i understand the guy's position, i wonder what he said to head office, he must have known deep down i was right. I'm so very interested to see what stage 2 of this is going to be.

I really hope it does not turn into a stress as ive got a few other things going on at the moment that are doing my head in. Fortunately i have a very dear person here in the garden keeping me calm regarding that.

he could have been nicer, anyone can be nice.:-6

you did remark on his looking intimidating and his patronizing you, and not to insult your intelligence.

There should be no stress whatsoever to ask for an exchange.

I hope it works out for you, trust me Buttercup, a tiny tear will lead to a much bigger one, especially on a cushion where its being stretched, then the good old white stuffing shows!:-5

Are they willing to give you a guarantee in writing that this repair will last? If not I would definately ask for my money back. Is this the only store that sells this sofa?

I'd just have it repaired, as long as it is a leather specialist.

It's a fair offer but no more than they are obliged to give. Take your money and go elsewhere. I'm no expert but if it was manufacturing fault in the tanning process a repair will just mask it for a while and it will come back, if it's a nick then it is a weak spot that will eventually give way over time. Alternatively accept the repair but ask for a discount on the price since the goods are damaged-effectively seconds and as such should not be the full retail price. Did you pay by credit card? If so you are also covered by the consumer credit act and the card company is also liable for any faulty goods. The mark up on furniture is 300-400% or more depending on the retailer (how else do you think they sell at half price and still make a profit, cut the price increase the turnover improve cashflow and make more profit on the improved sales) With small specialist retailers the mark up is probably higher are if they pitched at a premium market. There are dozens of leather suite retailers in the central belt all desperate to shift stock, especially in the current economic climate.

My wife has never forgiven me for ruining a leather suite by sitting on it with creosote covered trousers-I was doing the shed at the time and just didn't think.

I expressly forbid the use of any of my posts anywhere outside of FG (with the exception of the incredibly witty 'get a room already' )posted recently.

Folks who'd like to copy my intellectual work should expect to pay me for it.:-6

Consumer rights and where to get help : Directgov - Government, citizens and rights

Sale of goods act ^^ states that goods have to be of satisfactory quality; free from minor defects and if not you are entitled to a refund or replacement.

Can't quite understand why they won't offer a replacement - do they not offer that sofa for sale any more?

You don't have to accept a repair.

Just asked hubby - former upholsterer - what he would suggest. His words 'Leather cannot be repaired, the best they can do is glue it and it will be a weak spot. I'd either have a new one or my money back, I'd not accept a repair.'

Get them to take it away and refund your money BC. There must be loads of other retailers who'd trip over everybody in their dash for your custom ! Maybe even mention to the new retailers about your hassle and that's why you are shopping elsewhere. They may offer you a good deal, just to get the sale! :-6
