AN Egyptian al-Qaeda suspect and his family have won permission to live in Britain — and claim hundreds in benefits a month.
Ministers gave Hany Youssef “discretionary leave to remain”, even though the Home Office admits he is on a UN list of people “belonging to or linked” to the terror group.
The decision means he can stay in Britain with his wife and five kids up to 2011. He is also free to claim housing benefit, child tax credits and Jobseekers’ Allowance.
They have already been living in a house in Hammersmith, West London, at taxpayers’ expense.
youssef came here in 1994 and applied for asylum.
He was held briefly in 1999 under anti-terror laws and Tony Blair said it was “crazy” he could not be deported.
Youssef received damages in 2004 after the High Court ruled he was unlawfully detained.
The Home Office twice apologised for delays dealing with his application.
Hammersmith and Fulham MP Greg Hands discussed the case with then immigration minister Liam Byrne last year.
Mr Hands said: “He left me in no doubt he wanted to deport Youssef. I’m shocked they have secretly let him remain.”
The Home Office said: “Our aim is to deport people as quickly as possible but the law requires us to obtain assurances the person being returned will not face certain death.”

I think we need to take some of these labels we've been applying to folks and just toss them. We see 'senior al qaeda suspect' and tend to no longer care about things like proof ,whether in our justice system or anyone else's.
We need to go back to assuming innocence and not questioning someones patriotism simply because they ask for proof of guilt before accepting the label our government so quickly applied to others.

Flopstock has a point about throwing labels around, but I think in this guys case, he is a well known hard nut for al queda. I think that if there is such strong evidence that this indivdual was a member of Al Queda, or is a member, or has links to any other such group then he should be prosecuted under the British anti-terror laws for crimes in the UK or even abroad if the European convention on war crimes is applicable in his case.
If he is a British Citizen, and there is strong evidence he is trying to muder fellow citizens or subvert the state then charge him with treason and if he is guilty he should be dealt with accordingly. If he is innocent his family should get the same treatment as other Egyptian Asylum seekers, if he is guilty deport them forthwith. Are the Egyptian authorites looking for this man for any official crimes? If they are perhaps reciprocal arrangements could be made where the British would try and imprison him if he found guilty, and the Egyptians can pay the legal costs (thats a common sense idea so it won't happen).
There is definetly a set of very complex issues going on here concurrently. Countrys such as Britain have laws based on habeus corpus, trial by jury, and the presumption of innocence. Given the current situation with Islamic extremism and the real threat it poses domestically in Britain and Europe those concepts are being severely tested, hopefully a sensible way can be found that protects people both from terrorism, but also from an overly coercive set of anti-terror laws.
