Here is the latest news in our neighborhood.
Last year a Boulder Cop Shot an Elk that had been hanging out in a Boulder neighborhood for years.
His defense now wants to bring up the Elk's past behavior to show the shooting was justified.
Boulder DA seeks to exclude evidence Mapleton elk engaged in 'bad conduct' before being shot - Colorado Daily
"It is apparent that, at various points, the defense may take the position that the elk that was killed on Jan. 1, 2013, had engaged in 'bad conduct' on other occasions," Garnett wrote in the motion. "Because these alleged incidents are far removed in time from the date of the crime, none of these incidents are relevant to any of the defenses and there is no evidence that the defendant knew of those incidents of misconduct."

The cop decided he wanted the head for a trophy.

I watched some Doco on America one night about Elks that go on the rampage after getting drunk on fallen fermented apples...he should have used that In his defence..... Drunk !!!

So he never came up on his radio once to report the shooting? I don't think it was meat he was after...those are impressive antlers.$10,000 fine? ........That's also impressive

Yup he was after the trophy rack, and his buddy was going to take the meat.
Not sure how he could really consider it much of a trophy, though. Just walk up and shoot the thing while it was looking to see if he brought some food.
Around here, real hunters always have a story for any "trophy" the hang up on their wall. This gonna say, "He was standing there looking at me, and I pulled out my little gun and shot him."
I hope they find him guilty and lock him up with a bunch of sex offenders.

I thought one of the articles said it was a shotgun? unless he is highly trained at killing animals his revolver wouldn't have done the trick. It's usually two shots from a smaller firearm. (that's just been my experience ).

Trial to begin in killing of elk on Mapleton Hill - Longmont Times-Call
In the 15 months since former Boulder police officer Sam Carter shot and killed an elk on Mapleton Hill, the fallen elk has been the subject of songs, silent marches and plans for memorial benches. But sometimes lost amid the uproar over the elk's death from some and sighs of, "Only in Boulder," from others, an actual criminal case still looms.
"It would be a funny case but for the serious ramifications for the defendant and the sad end to that elk's life," said Denver defense attorney and former prosecutor Craig Silverman.
Carter, 37, is facing one count of attempting to influence a public official, a Class 4 felony; one count of forgery, a Class 5 felony; and two counts of tampering with physical evidence, a Class 6 felony.
Carter also is facing misdemeanor counts of first-degree official misconduct, illegal possession of a trophy elk with a Samson Law surcharge, conspiracy to commit illegal possession of wildlife, unlawfully taking of a big game animal out of season and unlawful use of an electronic communication device to unlawfully take wildlife.

An update:
The cop was convicted on all nine counts.
The Elk's behavior was examined. He had been a bit rascally, but was not found guilty of anything warranting his demise.
Sam Carter, ex-Boulder cop, convicted on all counts in Mapleton elk trial - Colorado Daily

That must be a first, a cop found guilty of "doing his duty" - you never know, they might have to apply the law if it carries on this way

Au contraire. He was circumventing his authority, hunting out of season, discharging a firearm in the city limits, bribing a law enforcement officer, and more, and then using the supposed misconduct of the elk to justify it when he got caught.

We should all be grateful Spot's not about anymore (wink) he would have loved a rogue cop with a gun story.
