As distasteful as it his tweets might have been, is this the best course of action ?

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances
Called the First Amendment. You can use one.

Just because you have a Twitter account. does not mean Joe Public can make your life a misery.
When people become Internet and Twitter trolls, they never give thought to the families of those people who are also affected.
When, after a year, I had no option but to go to the police myself, Frankly, wasn't too much of a concern for me but my husband who Is unwell, found It upsetting. Mind you, the fact that my troll knew my husband has a terminal Illness, made It all the more sick. The police were very good and took It as harrassment and Malicious communication..... maybe this Idiot will be a lesson to others .
There are actually people out there who search Facebook for memorials to the deceased and then target them, leaving vile comments.... Prison Is the best place for them.

At what point does free speech become incitement to hated?
It's all very well saying that people should be to say what they want but if what they want to say is that "all dem niggers should die" then it ceases to be free speech and becomes criminal lunacy.

I've no idea what the chap said. I'm quite sure the judge is off his trolley though, I've never heard such blatant twaddle in my life as his sentencing remarks. What a prat."It was not the football world who was praying for [Muamba].... everybody was praying for his life."
BBC News - Fabrice Muamba: Racist Twitter user jailed for 56 days
What utter cock and bull, sir. If you sleep at nights it's solely due to a lack of imagination. For starters most of the nation is incapable of distinguishing a prayer from a pop song, the idea of the unchurched being constantly engaged in pious ejaculation could only arise from a District Judge venting on full throttle.

We've had that. It's revolting. I guess every American's sentimental favorite is the Skokie, Illinois march by the American Nazi group & defended by the ACLU--American Civil Liberties Union, 99% defender of any other side but theirs.
Skokie, Illinois - Wikipedia, the free encyclopedia
National Socialist Party of America v. Village of Skokie - Wikipedia, the free encyclopedia
The Nazi's won their right to offend & attempt to intimidate the Jewish population, in fact the entire population, of Skokie. They were greatly outnumbered & jeered if I recall. Outnumbered by police, fed agents, etc. People came from 50 States & Many Nations & of course whole town was there. It is lunacy, especially since I'll bet proportionately at least, that all these type lunatics have guns. Everyone else seems to be arming to the teeth these days. American as Apple Pie, or, as H. Rap Brown once said "Violence is as American as Cherry Pie".
So I see that kid as being a dumb jerk kid. I see the sentence as astounding, & very wrong. Not a fan of nanny laws, or pc.

You might wish to arm your lunatics but we prefer to tell them when they've crossed the line.
In Europe we are going through an intensive campaign to stop "fans" making monkey chants at afro-carribean players - you might prefer to call that freedom of speech but we call it racism.
Nothing to do with nanny laws, more to do with standards of civilised behaviour.

Yes. About time, isn't it. That happened here, on a national level, in the 1940's. It never happens now, & that is against the law as a Hate Crime, which is on the fed & local books. This is not legal here, & it is shocking that in the 21st century white European fans throw bananas & make ape gestures openly to athletes.

I just don't like it. I show civilized behavior, it should be expected, many times is not in the population, but I think we must be careful with having such laws on the books.

I personally do not wish to arm lunatics. The gun laws are too loose.

Just remembered to say about half of our pro athletes are black. What do you think they would do? And, their salaries are nothing to jeer at. These jocks get more respect than almost anyone!
Nanny laws just reveal that parents are unwilling to parent, that people want police to police personal behavior, since they won't police their own kids or themselves.
Hate speech is covered under legislation, but it's really messy to start expanding on what is offensive to what should be illegal. There is criminal threatening, too.

Try and forget the Judges personality and his deviation from what you think the general populace might or might not be doing at any one time......
What about the prison sentence ?

The fact that he appeared in court and has been exposed for what he is, I think is enough.
I personally don't feel a custodial sentence is the right way to go, being suspended from Uni and de-registered as a rugby player has more impact I think

Simply fining the chap would have conveyed the entire sense of disapproval or, depending on what was tweeted, outrage. What he did was worse than giving a foul opinion in a pub, he directed it to the the immediate attention of Mr Muamba's friends and relations in a permanent format.
The Internet enables twerps to be far viler than was easy before it existed. Whether it's a matter for a court to slap them I doubt. Just stripping his anonymity and publicizing his behavior would already be a major step toward balancing the books, it would make job-hunting tougher once he graduates. Jail time is completely uncalled for.

It's less a matter of being bad that he said it than of being leary of how many others agree. If someone says "kill all yellow people" and no one else agrees the person who said it has no friends. What you don't like is the idea that enough other people agree with a racist statement that it's a problem. Problem is actually this: whether or not person A makes offensive comment, all the asswipes who agree with him/her still exist.

I have no problem with his directing hatred and contempt to the relatives of someone whose life hangs by a thread so long as he's aiming it at the family of an individual and his hatred and contempt applies to that individual by reason of who he or she is. That in particular is where the judge's "everybody was praying for his life" strikes me as totally irrelevant even if true which it blatantly can't have been. Many people, for example, will be praying for the good of that destroyer of society Lady Thatcher when she enters into her final approach to death but I guarantee I'll be cutting sandwiches for the street party and making sure I have a Union Flag to fly from the top of the flagpole. I shall especially try to upset her bloody son, tastefully and from a distance, probably by using the word Wonga several times in a thread here.
What makes his tweet a crime is that he aimed it on the basis of Mr Muamba's ancestry and colour - I presume this to be true and it seems likely, the court would have inquired. As such it's not a crime against Mr Muamba or his family, it's a crime against society at this particular moment given this island's historical record. For the good of society the law currently says that abuse directed on the basis of race or colour or sexuality or gender is either an offence or a magnifier of any other offence, depending on the charge brought. I see no reason why it should be disparaged, there are far worse laws on the books than that.

I regretted that Osama Bin Laden was killed rather than put on trial, if you remember. I don't recall criticizing Americans who celebrated his death. As for Lady Thatcher, may she live another hundred years. When the time comes to celebrate her departure I'll be waiting. She brought about the damage of too many people to ever be forgiven, not to mention the asset-stripping of the nation's wealth that she presided over. It's rather like expecting people to regret the similarity between the fates of Herod the Great and Ariel Sharon given that both are best remembered for presiding over the massacre of innocents.
