I read a similar story here In England only a few weeks ago. It was all to do with the husband giving his credit card details on the net and some-one using his card. Even though the porn was not on his pc, British police charged him and basically ruined his life and that of his families. At one time of day when he was supposed to have downloaded porn, he was actually standing In a church getting married. It went on for two years, The arresting officer even tipped off the local press and made his life a nightmare.
To cut a very long story short when the charges were finally dropped after he had to fight like hell, he sued the police force for malicious arrest and won getting thousands In damages.

While this might be a nuisance for the guy the fact remains that he should have protected his account. In 2011 and people are still oblivious of identity theft. I'm sorry but if one is as ignorant then they shouldn't be using a wi-fi connection.
And as far as the court is concerned the audio is more than enough to prove motive so Mr. "Doe" can chalk this one up to an invaluable lesson learned before he truly had his life ruined with $100,000's of dollars in debt...

Which part of BLIND man sued didn't you get? If he hadn't been blind it wouldn't get such interest. I don't have wifi and this highlights one of the reasons I don't. It's a form of theft, just being seen in the area doesn't necessarily make you the culprit. I don't have a lot of sympathy for the film and music industry, instead of embracing new methods of selling music they tried to prevent people enjoying it. I'm old enough to remember them trying to ban the sale of record players with combined tape decks because they wanted people to buy the tapes rather than record the records they already had. It seems to be finally dawning on them they can make money releasing old films and records to a generation to whom they are all new.
My attitude would be the same, All they can prove is someone used his IP address unless they can prove he actually downloaded it in to his computer they don't have a case. Especially, i would have thought if the man was blind. I have no sympathy for someone downloading or even looking at child porn but you do need to be careful. I know one security consultant who had a case where a malicious colleague put porn on to someone's computer at work, he was able to prove it in that instance but the consequences for the accused were a bit traumatic. . anyone can sue anyone else. The fact that a lawyer hasn't stepped up to take his case and counter sue makes me wonder what's not being said in the story.
