Is the rapist responsible for bringing the camera and turning it on?

I'm thinking if this becomes law a person committing rape is already breaking the law, whats to stop them from not recording their crime?

Anyone caught roaming the streets without a camera would be arrested for suspicion with the intent to rape?. Though with today's cell phones many rapists may slip through the cracks.
