If someone is living in a home rent free (basically leaching off the owner) and the owner decides after several years to throw them out, does that person being tossed out on their butt have a right to sue the owner? I mean, do they have tenents rights even though there was no lease or no rent being paid? Or does this all depend on the state they live in?

No - they, the free loaders have no proof of payment - they're loitering.
They do deserve a time limit to move - say 15-45 days and thats being generous.
And thats what the judge will say.. Its not their property, and only deserve a alloted time to move.
Sorry they have to move..

In my state, they must have 30 days written notice, asking them to leave. If they dont, you must take them to court. If you invited them to stay with you, and they are there more than two weeks, this applys.

Thanks for the info everyone. I'll let her know that she should check into the local laws first before she does anything - just to protect herself from future problems.
