I don't think this woman should ever see daylight or a blue sky again....
If she can do that to so many of her own children then think what she maybe capable of in the outside world..
She needs to be kept away and safe from herself and others safe from her...

If she is retried, the psychiatrist should be tried for wasting court's time (or at least should be made to repay his fee for a faulty statement; would you pay a car mechanic for not doing his job properly?)

This case just makes me sick. Not only should she not get a new trail, she should already be in the ground.

Of course the woman is mad - she killed her 5 children for crying out loud!! Just put her away somewhere. Don't keep tying up the courts to clear up "technicalities". :-5
of course, there are cases where experts testimony has been used to wrongly convict innocent people.
what one expert says, another would deny. So they aren't experts at all and should have no part in court procedure.

her husband should have been prosecuted along with her...he KNEW her mental history and KNEW she was a danger to the kids, and he left her alone with them nonetheless.

You know what? This makes me so angry at the unfairness of this world.
Here is this woman, Andrea Yates, who was blessed by God with five beautiful children. What does this psychopath do? She kills three of t hem.
Here sits this woman, here -- me, childless and always wanted to become a mother. (I'm 35 now, and the clock is ticking, by the way -- sad, but true.)
Did Andrea Yates really think that not having any children in her life would make her a happier person? What the heck was she thinking? Life is so empty and meaningless without a family to give all of your love and attention to. She's an idiot. She really did have it all, you know.
No, I don't think she should get another trial. She's sick and should never have become a mother in the first place. She didn't deserve those babies.

It was very obvious that Andrea Yates was a sick woman... her husband knew she had problems and he didn't do one thing to keep from having more children... they wanted to have as many children as God would give them...
It was a gorss miscarriage of justice when she was convicted of murder... she doesn't deserve to be out in society, but she does deserve to stay in a mental instituion instead of a jail cell.. she needs help.. and she will never be well....
But by God's grace there go I......

I would like for the whole thing to go away, but unfortunately, someone lied on the stand and therefore, by law, she has the right to another trial. I would prefer that the prosecution go forward with another trial vs doing a plea bargin, but I'm assuming that either way, it's going to end up the same. Life in prison, no chance of parole. I guess, they should save the money. Perhaps to prosecute the schmuck that lied to begin with.

Last I heard, he was completely supportive of her and her "mental" problem, and also how many did she kill..............not 3...wasn t' it 4 or 5??

she murdered all 5...but the prosecutors only charged her with 3 in case they needed to retry her for the other two to get the result that they needed. (her gone forever). ....oh, and her lawyer says now that she does not want to endure another trial, so perhaps they'll take a plea.

Once the issue goes to the court system, it ceases to be about truth, fairness, or justice. It's about 2 competitive, politically/financially motivated lawyers trying to win a debate, with a judge acting as debate referee. The victims are irrelevant in this system, except as evidence. Same for anything else connected to the case.
The system was set up with the hope and faith that the truth will out, and justice will magically be served. The defense lawyer simply found a loophole that gets him back into the game. The consequences of his actions, beyond building a reputation for tenacity, are not even in the equation at all.
The system may be the best around, but it still sucks in cases like this.

I cant believe I missed this thread. This makes me sick! I know this is a cliche but its how I feel and I will say it anyway:
After 2 miscarriages and 52 weeks of peeing on sticks, taking my temp every morning at the exact same minute, getting negative pregnancy tests every month, remebering to take vitamins every day at the same time AND taking fertility pills that give me hot flashes and night sweats at 28 yrs old and put me in the $hittiest mood ever, AND stressing about saving $40K for an adoption or even $20K for in vitro that might not even work anyway, I dont feel the least bit for these B^&$TCHES that kill their children, F%^#$ING Andrea Yates and Susan Smith should burn in Hell for eternity!!! They could have just given me their children no questions asked. F^%$ING worthless pieces of $hit.
PS. Sorry if I have offended anyone with my language. I know its horrible but seeing things like this just make me so mad I could spit nails, and since you can't hear my tone, the expletives really get my feeling across.

HOUSTON, Texas (AP) -- Andrea Yates pleaded innocent by reason of insanity in the drowning deaths of her children Monday as she made her first court appearance since her 2002 capital murder convictions were overturned.
State District Judge Belinda Hill set a March 20 trial date.
Yates, 41, will remain in the custody of the Harris County Sheriff's Department until she is retried for the deaths of three of her five children. Her attorney, George Parnham, had asked that Yates be sent to Rusk State Hospital until the new trial.
During her original trial, jurors rejected Yates' insanity defense and found her guilty for the 2001 deaths of three of the children drowned in the family bathtub: 7-year-old Noah, 5-year-old John and the youngest, 6-month-old Mary.
Evidence was presented about the drownings of the other two children -- Paul, 3, and Luke, 2 -- but Yates was not charged in their deaths.
Yates was sentenced to life in prison.
Her convictions were overturned last January by a state appeals court because of testimony by the state's expert witness, forensic psychiatrist Park Dietz. He testified that, shortly before Yates killed her five children, television's "Law and Order" series broadcast an episode about a woman with postpartum depression who drowned her children. No such episode ever existed.
